TERMS OF SERVICE

1. Acceptance

By creating an account or using Electric Baby Grand Studios ("EBGS", "the Service"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service. You must be at least 13 years old to create an account.

2. Use of the Service

EBGS is provided for personal and commercial music creation. You agree not to use EBGS to create, upload, or distribute content that is illegal, harmful, hateful, harassing, sexually explicit, or that infringes any third party's intellectual property rights.

3. Your Content & Ownership

You retain full ownership of all music, recordings, and audio you create using EBGS. We claim no ownership over your work.

By publishing a sample to the Sound Museum, you grant EBGS a non-exclusive, royalty-free licence to host, display, and distribute that sample within the platform so other users can preview and download it. You may retract a published sample at any time.

4. Upload Warranty

When you publish audio to the Sound Museum you confirm that:

You created the audio yourself, or you own the full rights to it;
It contains no samples, loops, or recordings owned by anyone else;
You grant EBGS the licence described in Section 3.

Uploading material you do not own may result in removal of the content and suspension or termination of your account. You are solely responsible for what you publish.

5. Artificial Intelligence Features

EBGS includes generative AI features, including AI song generation (Sound Kitchen), AI stem separation, AI-assisted sample chopping, AI cover art, and the S.M.I.L.E.S assistant.

⚠️ AI-generated content notice. Audio, artwork, and text produced by these features are generated by artificial intelligence. Output may be inaccurate, unexpected, or unintentionally resemble existing works. You are responsible for reviewing AI output before publishing or distributing it commercially.

AI music generation is provided via Kie.ai and is subject to their terms of service.
AI stem separation is provided via Replicate and is subject to their terms of service.
EBGS does not guarantee that AI output is free of third-party rights. You are responsible for clearing any rights before commercial release.
You may not use AI features to deliberately imitate a specific artist's voice or recordings, or to generate content that violates Section 2.

6. Reporting Objectionable Content

Every AI generation and every published sample includes a report (🚩) control. You may also email [email protected].

We review reports of objectionable, infringing, or abusive content and take appropriate action — including removal of the content and suspension of the responsible account — within 24 hours of receiving the report.

7. Tokens

🪙 Tokens have no cash value. Tokens are an in-app utility earned through community participation. They cannot be purchased, sold, transferred, exchanged, gifted, or redeemed for money or anything of monetary value. They may be used only to unlock features within EBGS.

Tokens are awarded for qualifying community contributions such as publishing samples to the Sound Museum.
Daily earning limits apply. Attempting to artificially inflate a token balance — including duplicate uploads, low-quality bulk uploads, automated submissions, or tampering with the application — will result in forfeiture of tokens and may result in account termination.
Tokens may expire, be adjusted, or be discontinued at our discretion. They are not property and confer no ownership rights.
Unused tokens are forfeited on account closure and are not refundable in any form.

8. Free and Pro Tiers

Free tier features are provided as-is with no guarantee of continued availability. Pro subscriptions are managed through our website at electricbaby.ca. Pro subscribers will receive 30 days' notice before any material reduction of Pro features. Subscriptions may be cancelled at any time.

9. Account Suspension

We may suspend or terminate accounts that violate these Terms, including uploading infringing material, abusing the token system, harassing other users, or attempting to circumvent technical protections.

10. Copyright & DMCA

If you believe content on EBGS infringes your copyright, email [email protected] with a description of the work, the location of the infringing material, your contact details, and a statement of good-faith belief. Valid notices are actioned within 24 hours.

11. Limitation of Liability

EBGS is provided "as is" without warranty of any kind. Zellisorange Music Technologies is not liable for any loss of data, loss of revenue, or other damages arising from use of the Service. You are responsible for maintaining your own backups of important work.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in-app. Continued use after changes take effect constitutes acceptance.
